1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between Padel Performance Center ("Company," "we," "our," or "us") and you ("User," "you," or "your"). By accessing, registering for, or using our website and services (the "Services"), you agree to be bound by these Terms. If you do not agree to any part of these Terms, you must not use our Services.

2. Use License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services subject to these Terms. This license permits you to:

  • Create and maintain a personal account
  • Browse and access available classes and services
  • Book and attend classes according to your subscription
  • View your profile and booking history
  • Communicate with our coaching staff

You may not use our Services for any unlawful purposes or in any way that violates these Terms or applicable laws.

3. User Responsibilities

You agree to:

  • Provide accurate, complete, and current information during registration
  • Maintain the confidentiality of your account credentials
  • Accept full responsibility for all activities under your account
  • Not impersonate or misrepresent your identity
  • Not share your account with others
  • Comply with all applicable laws and regulations
  • Not engage in harassment, abuse, or discriminatory behavior
  • Not post harmful, offensive, or illegal content
  • Not attempt to hack, exploit, or disrupt our Services
  • Notify us immediately of any unauthorized account access

4. Booking and Cancellation Policy

Booking Confirmation

When you book a class, you will receive a confirmation. This confirms your reservation in the class. Spots are limited and bookings are on a first-come, first-served basis.

Cancellations

  • You may cancel a booking up to 24 hours before the class starts
  • Cancellations made within 24 hours may result in a class deduction
  • No-shows will count as a used class slot

Class Reschedule

If you need to reschedule a class, contact us at least 24 hours in advance. We will make reasonable efforts to accommodate your request.

5. Subscription Terms

Our Services are offered through various subscription plans. By subscribing, you agree to:

  • Pay the subscription fee according to your selected plan
  • Allow recurring billing on the frequency you choose (monthly)
  • Provide valid payment information
  • Notify us immediately if your payment information changes
  • Accept potential price adjustments with 30 days' notice
  • Understand that subscriptions auto-renew unless cancelled
  • Cancel your subscription before the renewal date to avoid charges

Monthly subscriptions renew automatically on the same date each month.

6. Payment and Refund Policy

Payment

All payments are processed securely through Stripe. We accept major credit and debit cards. You authorize us to charge your payment method for any Services you purchase.

Refunds

  • Refunds are issued to the original payment method
  • Monthly subscription refunds are not available after the billing period begins
  • Class packages are non-refundable after purchase
  • Refund requests must be made within 30 days of payment
  • Promotional credits cannot be refunded

Late Payments

If a payment fails, we may retry the charge. Repeated failed payments may result in account suspension.

7. Intellectual Property Rights

All content on our platform, including text, graphics, logos, images, and software, is the property of Padel Performance Center or its content suppliers and is protected by international copyright laws.

You may not reproduce, modify, distribute, or transmit any content without our prior written permission. Your use of the Services does not grant you ownership of any intellectual property rights.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PADEL PERFORMANCE CENTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE INCURRED BY YOU OR ANY THIRD PARTY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE PRECEDING TWELVE MONTHS.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Health and Safety Disclaimer

Padel is a physical activity that carries inherent risks of injury. By booking and attending classes, you:

  • Assume all risks of personal injury
  • Represent that you are physically fit to participate
  • Acknowledge that you have consulted with a healthcare provider if necessary
  • Release Padel Performance Center from liability for injuries
  • Agree that you participate at your own risk

Please consult with your doctor before starting any new physical activity, especially if you have pre-existing health conditions.

11. Termination

We reserve the right to suspend or terminate your account and access to our Services if you:

  • Violate any provision of these Terms
  • Engage in harassment, abuse, or illegal behavior
  • Repeatedly fail to pay subscription fees
  • Breach any representation or warranty
  • Violate applicable laws or regulations

You may terminate your account at any time by canceling your subscription through your account settings.

12. Modifications to Terms

We may modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our Services after modification constitutes acceptance of the updated Terms.

We will provide notice of material changes via email or through our Services.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Padel Performance Center operates, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of our Services shall first be addressed through good-faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or litigation as permitted by law.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
